Terms of Use
These Terms govern your use of Kids Display, a service that helps churches and similar organizations show videos, slides, PDFs and images on TVs. "We" and "us" mean [Operator name], the operator of the service. The Acceptable Use Policy and the Privacy Policy are part of this agreement.
1. Agreement and who is bound
To use the service you must accept these Terms, the Acceptable Use Policy and the Privacy Policy by clicking "I agree". We record which version you accepted, a fingerprint of its text, and when, from where (IP address) and with what browser.
If you use Kids Display on behalf of a church or other organization (the "Organization"), you agree to these Terms on its behalf and confirm that you have authority to do so. The Organization is then the party to this agreement and is responsible for its users.
Updates. We may update these documents. When a new version of the Terms, the Acceptable Use Policy or the Privacy Policy matters (a "material" update), you must accept it before you can keep using the service. Continued use of the service requires accepting the current version and every future material version. If you do not accept, you must stop using the service. Smaller updates, such as typo fixes, are shown as a notice. Earlier versions stay available at All legal documents.
2. The service: free, closed alpha, may change or end
The service is free. It is an early, actively developed alpha. Features may change, break or be removed without notice. We may change, suspend or discontinue the service, or any account, in whole or in part, at any time. Where practical we will give notice.
3. Eligibility and accounts
- The service is offered in the United States only, for now. If your Organization is outside the United States, please contact us before signing up.
- Users must be adults (18 or older) acting for the Organization. The service is not for children to use.
- The Organization decides who gets access. It must keep passwords, TV pairing and controller QR links confidential. Anyone who holds a controller link can control that TV.
- Tell us promptly if you suspect unauthorized access to an account. Use the report form.
4. Your content and your responsibility
The Organization keeps ownership of everything it uploads, links or writes ("Content"), such as files, YouTube links, video links and text slides. It is solely responsible for its Content and for what its displays show.
The Organization confirms that it has every right, license and permission its Content needs. For example:
- music, lyric and video licenses, such as CCLI or the Church Video License;
- permission to publicly perform YouTube or other videos where that is required;
- consent from the people shown, including parent or guardian consent for images or names of children, as the Organization's own policies and the law require.
5. License to us
You give us a limited, non-exclusive, royalty-free license to host, store, copy, process and transmit your Content, for example to turn PDFs into images or to make thumbnails. We use it only to operate the service for the Organization and for the purposes in sections 7 and 8. The license ends when the Content is deleted, except for copies we must keep for legal reasons (section 7) and copies that remain in backups for a limited time (section 10).
6. We do not monitor content, but we may act on it
We do not pre-screen or routinely monitor Content, and we are not responsible for Content provided by Organizations or users. We may nevertheless review, remove or disable access to any Content, and suspend or end any account, at our discretion and without notice, if we believe these Terms or the Acceptable Use Policy have been violated, in response to a report, or to protect people, the service or ourselves. We are not obliged to do so.
7. Records, logs and legal requests
We keep records of account activity: who signed in, who uploaded or changed what, when, and from which IP address. We use them for security, to investigate abuse and to meet legal obligations. The Privacy Policy describes what is kept and for how long.
Our staff can access Organization accounts and Content for support, safety and legal reasons. That access is logged.
We follow applicable law. We may preserve and disclose account information, logs and Content:
- when we believe in good faith that the law or valid legal process requires it;
- to report apparent child sexual exploitation to the National Center for Missing and Exploited Children (NCMEC) and law enforcement, as the law requires;
- to prevent imminent harm to a person;
- to protect the rights and safety of the service, its users and others.
8. Reporting content; copyright
Anyone can report content using the report form. Copyright holders can send notices as described in our Copyright (DMCA) Policy. We follow the notice and counter-notice process in 17 U.S.C. section 512, and in appropriate circumstances we end the accounts of repeat infringers.
9. YouTube and third-party content
YouTube videos play in YouTube's embedded player. By using the service you agree to be bound by the YouTube Terms of Service, and Google's privacy policy also applies (see our Privacy Policy). We do not control third-party videos or sites. They may become unavailable at any time, and we are not responsible for them.
10. Data loss and backups
This is an alpha. We keep limited backups of the database and of uploaded files, but we do not guarantee them, and data may be lost or reset. Keep your own copies of anything you upload or rely on.
11. Disclaimer of warranties
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability and error-free operation. We do not guarantee that a display will work on any given Sunday.
12. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, consequential, special or punitive damages, or for loss of data, content, profits or goodwill. Our total liability for all claims relating to the service is limited to US$100, since the service is free. Some places do not allow these limits. There they apply only to the extent permitted.
13. Indemnity
The Organization will defend and indemnify us against third-party claims, and pay the resulting damages and reasonable costs, to the extent they arise from the Organization's Content, from its users' conduct on the service, or from its breach of these Terms. We will tell the Organization about a claim promptly and let it help with the defense.
14. Suspension and termination
Either side may stop at any time. The Organization can ask us to close its account using the report form. After closure we delete the Organization's Content within the periods in the Privacy Policy, except for records we must keep for legal reasons or under a legal hold. Sections 4, 5 (as to retained copies), 7 and 11 to 15 survive termination.
15. Governing law, disputes and changes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Courts located in [County] County, Texas, have exclusive jurisdiction, and you consent to them. If a part of these Terms is unenforceable, the rest stays in effect. These Terms, the Acceptable Use Policy and the Privacy Policy are the whole agreement between us about the service.
We may update these Terms as described in section 1.
16. Contact
